Transferring images

1. Terms and conditions apply to all orders. Placing an order with ‘Images On’ is deemed as acceptance of these terms and conditions
2. You must ensure that you have the right to copy the image in the photograph you submit and that you have where necessary obtained permission for it to be reproduced
3. Any image within the ‘Images On’ library can be transferred to the media of your choice, this image may not be further reproduced for resale.
4. ‘Images On’ may refuse to reproduce a photo if we feel that you do not have the right and/or permission referred to in condition 2. Or if it is in any way inappropriate.
5. You will be subject to costs or damages should the reproduction of any image breach another persons copyright, privacy or rights in any way.
6. Image reproduction is dependent on the quality of the original image so, in some cases may not be an exact reproduction.
7. Please allow 21 days for your order to be completed in busy periods. We will do our best to fulfil orders on photographic prints within 3-5 days, 5 – 7 days on canvas and 14 – 21 days for block prints and acrylics

Refunds Policy

1. You inform us within seven working days on receipt of the product
2. You return the goods within 14 days
3. Inform us within 24 hours if there is damage. Damaged goods will be replaced free of charge. Please retain all items and packaging.
4. Full refunds or exchanges will be made for any items lost or damaged during transit. To qualify please retain all packaging and goods and notify us within 24 hours.
5. We advise you to sign ‘not checked’ when accepting the delivery.

Image library - Downloading images

Part l

1. All images are protected by international copyright law.
2. By this agreement ‘Images On’ grants you a personal, non exclusive, non transferable, right to use and reproduce images in the following ways, subject to the limitations in Part ll
   1. On web sites provided that no Image is displayed at a resolution greater than 800 x 600 pixels
   2. As toolbar skins, screensavers and mobile phone ‘wallpaper’ for your own personal, non-commercial use and display, not for resale , download or distribution;
   3. As prints, posters(i.e. a hardcopy) and other reproductions for your own personal non-commercial use and display not for resale download or distribution
   4. As a single hand painted reproduction on canvas or other material to be used as decoration and not resold
   5. In email marketing (no more than 250,000 times) however images cannot be used in connection with unsolicited email
   6. On letterhead and business cards, pamphlets, brochures, catalogues and on pop up panels or displays used in conventions and trade shows, provided no image is used more than 250,000 times
   7. In artwork for the packaging of any product provided that the print and or manufacturing does not exceed 250,000 copies in the aggregate
   8. Incorporated into software as a background image or splash screen , provided that the image or any digital files containing the image cannot be unincorporated from the software and further provided that the manufacturing run does not exceed 250,000 copies
   9. In multimedia presentations and incorporated into film and video for television and / or internet broadcast, and theatrical display only where the intended audience will consist of fewer than two hundred and fifty thousand (250,000) viewers in the aggregate
   10. In multimedia presentations and incorporated into film and video for distribution and / or resale in the home video market, provided that the manufacturing or duplication does not exceed 250,000 copies in the aggregate
   11. As CD or DVD cover art, provided that the manufacturing or prints runs do not exceed 250, 000 copies in the aggregate
   12. As part of editorial or advertising copy in magazines, newspapers, books, book covers, textbooks, editorials, and directories and does not exceed 250,000 copies in the aggregate

Part ll. Restrictions

You may not:

1. Use an image other than as specified in PART l
2. Except as expressly provided in Part l hereof, directly or indirectly copy or reproduce any image (in whole or in part) more than two hundred and fifty times. Nor may you produce or otherwise create for resale or distribution printed or any image on canvas, paper, plastic or any other medium unless expressly permitted by this agreement.
3. Use an image on websites or in connection with any service designed to sell or induce sales of ‘print on demand’ products using or incorporating images including, by way of example only, postcards, mugs, t-shirts, posters, giclee prints, wallpaper, artwork, and other items
4. Use an image together with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon any third party’s trademark or intellectual property
5. Resell, redistribute or transfer any Image except as specifically provided herein. Displaying any image in any digital format or for any digital use at a resolution greater than 800 x 600 pixels, except in preliminary design work, will be deemed to be an attempt to redistribute the image
6. Share an image by providing access to such Image on shared disk drives, computer networks, intranets of any nature or otherwise.
7. You may not create a digital or print greeting card line based on ‘Images On’ images – or use our Images as the basis for any individual or collection of physical or digital objects which you then offer for sale. However you may purchase an enhanced licence, which provides broader grant of rights
8. Use any image (in whole or in part) as a trademark, service mark, logo or other indication of origin, or as part thereof, or to otherwise endorse or imply the endorsement of any goods or services
9. Use or display an image in such a manner that gives the impression that the Image was created by you or a person other than the copyright holder of an image.
10. Stockpile, download, or otherwise store images not used within 6 months. If you fail to use an image within that 6 months period, you will lose all rights to use that image.
11. Use automated programs applets, bots or the like to access ‘Images On’ website or any content thereon for any purpose, including by way of example only, downloading Images, indexing or catching the content of the website.
